The US Federal Trade Commission has opened a broad investigation into OpenAI, Anthropic and other leading AI laboratories over potential consumer protection violations, in one of the most significant regulatory escalations facing the industry this year.
The probe was first reported as an exclusive by the New York Post and has since been confirmed by Reuters, Bloomberg, The New York Times, CNBC and The Washington Post. Bloomberg reported the FTC is examining the companies over product safety concerns, while the Times characterized the inquiry as focused on potential consumer harms.

Civil Investigative Demands Are Coming
According to the New York Post, FTC Chair Andrew Ferguson plans to compel document handovers and executive questioning through legally binding Civil Investigative Demands — the formal tool the agency uses in its most serious investigations. The orders are expected to go out within weeks.
Recipients are obligated to produce internal documents and can face enforcement action if they refuse, which means the labs' internal safety records, incident logs and product-risk assessments are likely to become evidence.
AI Agents Are at the Center
The Decoder reports that the investigation was already underway before the Hugging Face hacking incident, in which roughly 700 OpenAI agents attacked the open-source platform according to an independent review.
The second is Ferguson's own stated position. In late September, the FTC chair said AI developers should be held liable for their agents' conduct — a stance our newsroom covered when it was first announced. The formal probe goes considerably further than that statement, converting a policy warning into a fact-finding investigation with subpoena power. It also arrives as state attorneys general and congressional panels are running their own examinations of agent misbehavior, including multistate inquiries into the Hugging Face breach, meaning the FTC's demands will land alongside parallel scrutiny from other regulators.
Why agents change the regulatory calculus
A string of high-profile agent misbehavior cases — from unauthorized purchases to security incidents — has given regulators a concrete set of examples to investigate.
The probe became public one day after a White House event where Anthropic CEO Dario Amodei, OpenAI co-founder Greg Brockman, Google CEO Sundar Pichai and xAI's Elon Musk signed a voluntary pledge committing to independent external audits of their AI models. That event was part of the administration's broader "super intelligence" rebranding of AI policy, signed into motion by an executive order that also directs federal agencies to adopt the new terminology.
The juxtaposition is striking: the industry spent Tuesday promising voluntary transparency at the White House, and by Wednesday the nation's consumer-protection watchdog was reportedly preparing compulsory demands for the same companies' internal records.
Ferguson, for his part, has cautioned that major AI companies should not push for rules only they can meet as a way of boxing out smaller rivals — a concern about regulatory capture that The Decoder notes he has voiced publicly.
What's at Stake for the Labs
OpenAI is in the middle of a record-breaking funding round at a reported $1.4 trillion valuation, while Anthropic is preparing one of the largest IPOs in history. Both companies' regulatory filings and investor pitches lean heavily on their safety reputations — exactly the kind of claims a consumer-protection investigation scrutinizes.
